Kaua'i Teen Court

Kaua'i Teen Court is a diversion program for first time juvenile offenders. The program is voluntary, and even though the setting is less formal than Family Court, the same rules of confidentiality, promptness, and respect for the process apply.

The program is based on restorative justice and the ability of the offender to make things right, instead of punishment. One of the primary goals of Kaua'i Teen Court is to build skills, promote competency, and leave the respondent with new choices, which will hopefully prevent re-offenses.

Successful completion of the program means that the respondent will have no juvenile court record.

Participation in Kaua'i Teen Court requires that the respondent plead guilty as charged. The respondent then attends an Intake Session with one or both parents present, and a Hearing date is assigned. The Hearing is held before a jury of teens, some volunteers, some former respondents, with a judge presiding. Teens take the roles of prosecutor, defense attorney, and court clerk. The respondent will have two opportunities to address the jury and speak about the incident. If the respondent does not wish to speak to the jury directly, the defense attorney will speak on their behalf.

Sentencing elements may include community service, serving as a Teen Court juror, mandatory attendance at a skill-building class or getting counseling, and possibly having to write a letter of apology to the victim. Restitution to the victim is also mandatory if the victim suffered a financial loss (for example, medical bills, or loss or damage to property). If a victim impact statement exists, it may also be read into the court record.

It is important that respondents complete their sentencing requirements as soon as possible. Failure to complete sentencing requirements in a timely manner will result in the case being sent back to Family Court. It is understood that participation in this program means that the respondent and their parent(s) will give this their highest priority; we want to help respondents succeed.
